The next 45 should get one put in their files next. 384.1 A proceeding commenced by a member of a class of persons on behalf of the members of that class shall be conducted as a specially managed proceeding. So the fact I'm asking for relief that affects all Canadians forces it to be a spccially managed proceeding. So why were judges appointed as Case Management Judge the last two times large groups of self-represented plaintiffs used my templates to file common grievances but this time we get a less powerful Prothonotary? Section 383 of the Rules allows a Prothonotary be appointed a Case Management Judge. Unfortunately, that's going to cause us problems because a Prothonotary doesn't have the same powers of a judge. Appeals of Prothonotaries' Orders 51 (1) An order of a prothonotary may be appealed by a motion to a judge of the Federal Court. (2) Notice of the motion shall be served and filed within 10 days after the day on which the order under appeal was made and at least four days before the day fixed for the hearing of the motion. JCT: So if we don't like a decision, we have to go to a regular judge before moving up. An extra step for issues the Prothonotary cannot deal with. So what are the powers of the Prothonotaries? Prothonotaries 50 (1) A prothonotary may hear, and make any necessary orders relating to, any motion under these Rules other than a motion (c) for summary judgment or summary trial other than.. JCT: "actions under $50,000 which the Prothonotary may hear. Crown is in default for the last 10 days. Last time Her Majesty was in default, I moved for Summary Trial and Judgment. Looks like I won't be allowed to do that with a Prothonotary. Wonder what I'm supposed to do? (e) for an injunction; JCT: So what if I want an interim injunction until trial to prohibit some particular restriction, curfew, mask, social distancing, incarceration, mandatory vaccine? Prothonotary can't help me. What can I do? Ask, get refused for no jurisdiction, appeal? Can't appeal a right decision. (l) for the certification of an action or an application as a class proceeding. JCT: Let's say I get suicided, WHO would do that? But if the group wanted to then hire a lawyer to represent the whole class, you can't ask the Prothonotary to be certified as a class action. So what to do? Do we make a motion to a judge? Say: Prothonotary can't deal with this so I'm moving to be heard by a judge. Kind of like the motion to appeal to the judge, judge without asking? So we've been stuck with a Case Management Judge without the power to deal with some of our potential issues. What to do about that? It is kind of insulting to be given a judge without the power to do the things previous judges had to power to do. Guess I'm going to have to write to the Chief Justice to point out the things a Prothonotary can't do for us and ask what we should do to seek that relief from someone else.
